TERMS AND CONDITIONS

INTRODUCTION

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, “the customer”) and The Nerd Hut (“we,” “us” or “our”), concerning your access to and use of the www.TheNerdHut.co.uk website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

The Nerd Hut reserves, under sole discretion, the right to change these Terms and Conditions where necessary, without prior notice to you. Any changes to these Terms and Conditions will take effect from the time of posting. It is your sole responsibility to check these Terms and Conditions regularly for updates.

ORDERS

When a customer places an order on the Site, it is a formal offer to purchase the selected products. Upon order, The Nerd hut will send an email to the customer confirming their products orders and payment due, including shipping fees. Note; this email is neither a guarantee or invoice.

A contract is agreed between the customer and The Nerd Hut upon receipt of payment, including but not limited to credit/debit card charge or bank transfer.

PRICING AND PAYMENT

All pricings on the website are in £ sterling and include V.A.T where appropriate.

We work to ensure all information is correct and up-to-date on the Site, however, error may occur and The Nerd Hut reserve the right to alter product pricing as appropriate, without notice.

In the event that The Nerd Hut changes the pricing of a product due to an error, the customer will be provided with the option to continue with the purchase at the new, corrected price, or cancel the order. If the customer chooses to cancel their order and has already paid for the goods in question, The Nerd Hut shall refund the full amount in accordance with these Terms and Conditions.

The Nerd Hut are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent an order confirmation email, if the pricing error is obvious and unmistakable and could be reasonably recognized by you as a mis-pricing.

The customer should be aware that The Nerd Hut does not consider a pricing adjustment due to promotion, sale or other offer as an error in price, and the above Terms do not therefor apply.

Ownership of goods does not pass into the hands of the customer until full payment has been received by The Nerd Hut.

DELIVERY & SHIPPING

Orders are endevoured to be dispatched between 3 – 5 working days.

Product prices listed on the website don’t include delivery and shipping fees.

Shipping fee’s are presented in the customer shopping cart and form part of the customer’s final total. Shipping fees are a flat rate, and are subject to change and update at any time without prior written notice.

Delivery is only available to a UK address, and goods will be shipped to the address provided at checkout by the customer. The Nerd Hut reserves the right to refuse to deliver to an address they believe to be unsecure. This address could be, but not limited to, a communal postal address, a BFPO or a PO box.

The Nerd Hut is not responsible for guaranteeing delivery times, and any estimated delivery times are those provided by the delivery company in question.

The Nerd Hut will dispatch all products ordered once all available; in relation to pre-orders, this will occur when the latest date pre-order has arrived and/or when delivery ensures arrival on release day at the earliest.

The Nerd Hut will not be liable to the customer in the event that The Nerd Hut is prevented by circumstance from delivering goods that the customer has ordered.

Please note we are closed on Bank Holidays, and no products will be shipped on these dates.

CANCELLATIONS AND RETURNS

The customer may cancel their order at any time, for any reason, and returned within 14 days. In the instance the customer would like to cancel their order, they must do so in writing via email to cancellations@thenerdhut.co.uk.

Should the customer invoke their right to cancel, the following Terms apply.

If the customer cancels their order before dispatch, their order will be cancelled and no cost will be charged to the customer, a full refund being provided if payment has already been received by The Nerd Hut before dispatch.

If the customer wishes to return goods within 14 days, these products must be returned to The Nerd Hut in their original packaging and in a resalable condition with all seals and wrappings. If goods are returned not in the above listed state, the customer revokes their right to any refund.

In this instance, the customer undertakes the responsibility to return the goods to The Nerd Hut. Any return postage costs will be paid by the customer for unwanted items.

The Nerd Hut can not be held responsible for any supplementary costs incurred by a customer caused by a delayed/lost/misrouted orders.

The Customer must return the item to The Nerd Hut within 14 days of receipt to qualify for a refund.

DAMAGED OR FAULTY GOODS

In the event of faulty, defective, or goods damaged before receipt by the customer, please contact us at hello@thenerdhut.co.uk with your order number and detail of fault to arrange return of your item.

All original packaging should be included in the returned items.

Faulty goods must be returned within 28 days of receipt by the customer to qualify for a refund.

The Nerd Hut will offer a replacement for the same product(s) that were faulty or damaged. Where we cannot offer a replacement, we will refund the cost of the item(s) and postage where applicable.

INTELLECTUAL PROPERTY

All content of this website is the property of The Nerd Hut. The customer may access any part of this website and download or copy material for personal use only. The customer may not download or copy material for use in conjunction with any other website or business.

Where the owner of the material has licensed that material to The Nerd hut, the copyright is retained by the owner themselves.

The customer may not remove any copyright, trademark or intellectual property notice contained in original material from any material downloaded from this website.

All trademarks appearing on this website are the property of their respective owner. Use of these trademarks is forbidden unless written permission is obtained from the owner of the trademark.

LOYALTY PROGRAMME

The Loyalty Programme for The Nerd Hut is the Square Loyalty Programme.

The Terms & Conditions for the Loyalty Programme are listed as follows:

By opening a Loyalty Programme account with The Nerd Hut to receive benefits of the Loyalty Programme, including, but not limited to, loyalty points, you agree that:

• You are aged 18 or over.
• You have read and accepted these rules; as well as also having read and accepted The Nerd Hut Terms & Conditions, Privacy Policy, as well as the Square Terms of Service.
• You consent to the collection, use and disclosure of your personal data by The Company and Square in accordance with The Nerd Hut’s Privacy Policy & Terms & Conditions.

All Loyalty Programme benefits, offers, awards and services are subject to availability. The Nerd Hut may terminate the Loyalty Programme, in whole or in part, with one (1) months notice to current members and with less than one month’s notice in jurisdiction if required to do so by applicable law.
In relation to termination of the Loyalty Programme, members have the notice period to use any remaining and unspent point, after which date any unused points will be voided and not usable in any format.

These Loyalty Programme Terms & Conditions supersede all previous Terms & Conditions in relation to the Loyalty Programme.
Where the Loyalty Programme Terms & Conditions do not cover an aspect of membership, the customer will refer to The Nerd Hut’s general Terms and Conditions, Privacy Policy and Square Terms of Service 

DATA PROTECTION

Personal details provided by the customer to The Nerd Hut through this website will only be used in accordance with The Nerd Hut privacy policy. By providing personal details to The Nerd Hut you are consenting to use of those details in conjunction with the Privacy Policy laid out on the website. The customer should ensure they have read the Privacy Policy before proceeding use on The Nerd Hut website.

OTHER

The Nerd Hut accepts no liability for any errors or omissions, and reserves the right to change information, prices, specifications and description of listed goods, products and services.

The Nerd Hut will endeavour to correct errors and omissions as quickly as practical after being notified of them.

It is a crime to use a false name or invalid credit or debit card. The Nerd Hut will prosecute anyone found willfully entering a fictitious order to the fullest extent of the law.

If any single provision of these Terms and Conditions is found to be invalid by a Court of Law, the invalidity of that single provision will not affect the remaining provisions of these Terms and Conditions, which will continue to have full effect.

These Terms and Conditions shall be construed and interpreted in accordance with the relevant United Kingdom laws. The Courts of the United Kingdom will have exclusive jurisdiction in relation to any claim, dispute or other matter arising from these Terms and Conditions, the Customer’s use of this website or the supply of the product by The Nerd Hut.
